What's the minimum sentencing in CA for such an offense? 46 years?
He should have just shoplifted a real bat and a flashlight, and a roll of duct tape. I think the local DA's office throws you a party instead of charging you for that...

@RWT1405. Have you tried running 6ea L92 Energizers in a bat?
The 1.5v lithiums have gotten so dang expensive, I'll probably use white Eneloops.
I'm glad you mentioned that. I keep a pair of those just for disasters (Eneloops are life), and was looking to pick up another pair when I saw how expensive they'd gotten. At this rate, I might as well just light the money on fire for light, haha.

On the upside, they have a long shelf life, so if lithium prices ever dip, and they move down, I might grab another pair for storage.

I guess the bigger question is, how does it stack up versus a 3D Maglite (with a better emitter option) full of D-cells?

That would be my concern with these; it seems targeted for more restrictive states/countries, but also...it seems pretty obvious...Versus the legendary plausible deniability of the Maglite.
I'm just running through a scenario where something happens, the police get involved, and comparing how I see things turning out if I had one of these in my hand versus if I had a Maglite, and it seems like a lawyer would have a REALLY EASY case that I was the aggressor "looking for trouble" with this Nebo.

Because, fundamentally, at the end of the day, so much comes down to what a lawyer can realistically have a shot of convincing people, not the reality.

This is actually very much related to the firearms community where people have run into serious problems from having firearm modifications on a firearm used in actual self defense; lawyers can argue you were "preparing" for an offensive use, and either you end up in hot water, or there's less consequences for the criminal, as they're now portrayed as the victim. That's the whole argument for your "home defense" firearm should be very basic and unassuming.

TFB TV had an interesting video where James Reeves (Mr. Gun Shorts) looked at how weapon used in defense affected perceptions to juries, and that was kind of interesting, titled, "How and AR-15 can send you to prison."

While I know people like to be a bit flippant on these topics, "I don't care, cause I'm morally justified!" I think we do need to all be cognizant of the fact that, regardless of how justified we are in our actions...we can still end up in prison...which would suck. I mean, I fully agree it's insane and Orwellian that people can defend themselves and end up in a situation where they're being charged with crimes, but then I remember EVERY criminal, ever, claims their violence was in self-defense.

I'm not sure if I'm going to risk my freedom, just in case some DA wants to "make an example out of me" to build their career.

Semi-related, this is why I am not a super fan of the hyper aggressive strike bezels on a lot of lights. More subtle ones work just fine, are more practical (don't shred pockets or damage shelves/desks), and won't land me in hot water were something to happen. You're just seen more as someone who IS a victim, who was so desperate, you had to use a FLASHLIGHT? I'd guess a typical Malkoff MD2 would do quite well in that situation versus most anything else, and juries would just feel sad for the poor slob who had to use some "small" flashlight in such a situation, haha.

Legality kills the justice system...carrying self defense items is intended for self defense, same as a jacket is intended for self preservation. A prosecutor's job is to establish mal-intent. Context be damned unless it benefits them. Establishing mal-intent is MUCH easier than establishing legal intent, and is similar to how casinos are stacked against a player: they let you believe you have a chance.

Just remember in the modern kangaroo court of law, Logic, Morality, and Rationality almost never prevail. What does prevail are public opinion, optics, and precedence (no matter how flawed).

As I've gotten older, I've begrudgingly learned to accept there is the world we live in, and it does not care about the world we should live in.

To point, I've gotten a LOT more thoughtful about how things can be used against me.

There was a meme floating around where someone, using a kid voice, says "pick up a WEEL(real) gun!". Looks like you've done both, lol.

As far as the Nebo goes, while I have no interest in it, I am curious as to how different battery chemistries would hold up to the physical abuse. LSD NiMH don't like physical abuse, and lose their LSD if abused too much.
 
If I step out of my car holding my Cold Steel Brute, shining the light on one of my tires of course, I think it unlikely than anyone would approach me with malicious intent. If it was a mugger or the like, I imagine they would decide to move on to a more appropriate 'victim'. Would I try to mug someone walking a pit bull on a leash? I have zero training in fighting with my hands, but If one was struck almost anywhere with the thing, by almost anyone who could swing it, I imagine it would almost certainly result in a serious injury (at least a bone fracture).

It lived in my car somewhat concealed, but within instant reach for many years, and while I do use it occasionally as a flashlight, I've never struck anything with it and don't expect I'll ever need to. For the record, I was also a CA resident most of that time. BTW, yes, it has always worked when I push the button.

I also don't smash watermelons with it like ol' Lynn Thompson did either, but I imagine if I ever had to use it 'in anger', the last thing I would ever even think of would be the effect on the cells/batteries inside - or the filament in its incandescent bulb. I'd pull my carry light out of my pocket if required to inspect the damage;-)

I also see practically no valid, useful analogy to a firearm. I consider that a stretch. My illegally carried firearm at the time would be a very different discussion.

On that very different subject however, as someone else already stated, modifications made to a gun can create and has created liabilities in court in some cases, so I think twice about those.

There's a reason why NEBO recommends alkalines. Also, It's a truncheon, a baton, a club. "Hey! Let's stick a flashlight on the end of it and pretend it's not!" Yeah, no; doesn't work that way.

I’ve been using one of the older versions of this light to chip snow and ice out of my wheel wells for almost a decade if not longer. The light held up very well, barely any damage. It’s currently in the urgent care wing of my workbench for alkaline leak treatment. All this time I could’ve sworn I put L91’s in it. Thankfully it was a battery by the tailcap that leaked and not bybthe head.

Yep, AlkaLeaks should ALWAYS be stored separately, and NOT stored inside devices

AlkaLeaks are ONLY to be used for Emergency use, and then removed
